Employment of war veterans as a result of professional adaptation: legal issues and challenges

Соціально-трудова сфера держави зіштовхнулася з низкою правових проблем, зумовлених необхідністю здійсненням професійної адаптації ветеранів війни – групи осіб, які потребують допомоги у поверненні до цивільного життя. Проблемою держави є неготовність ринку праці та соціальної сфери до працевлаштування і соціальної підтримки великої кількості осіб, потребуючих при цьому особливого підходу до праці, яку вони здатні виконувати, облаштування робочого місця і адаптації їх до мирного життя у колективі. Гідне повернення ветеранів війни у соціум може бути забезпечене за допомогою професійної адаптації, саме тому метою статті є з’ясувати стан правового регулювання професійної адаптації ветеранів війни в Україні, дослідити види професійної адаптації ветеранів війни і послуги, які пропонуються державою цій категорії осіб у сфері професійної адаптації, з’ясувати напрями повернення ветеранів війни до праці за результатами їх професійної адаптації і проблеми їх правового регулювання. Проведене дослідження сфери професійної адаптації ветеранів війни дозволяє виснувати, що держава приділяє увагу правовому регулюванню зазначеної сфери суспільних відносин, зокрема, осучаснюється законодавство, яке встановлює види професійної адаптації ветеранів війни і послуги, пропоновані державою у цій сфері. Пропонуємо визначити три напрями повернення ветеранів війни до праці внаслідок їх професійної адаптації: (1) традиційне працевлаштування у формі найманої праці згідно із Кодексом законів про працю України; (2) працевлаштування на умовах нестандартної зайнятості; (3) започаткування і розвиток ветеранського підприємництва. Автором зазначено, що для повноцінного застосування інституту нестандартної зайнятості та ветеранського бізнесу державі необхідно вирішити низку правових проблем, пов’язаних із правовою невизначеністю форм нестандартної праці, трудових прав працівників, задіяних до такої зайнятості, а також унормувати ветеранське підприємництво як вид господарської діяльності, визначити фінансові механізми його підтримки.
