TASKS AND POWERS OF THE MINISTRY IN THE SPHERE OF SCIENCE (EXPERIENCE OF THE CZECH REPUBLIC, THE REPUBLIC OF FINLAND, THE REPUBLIC OF LATVIA, ROMANIA)

Problem setting. Currently, it is relevant to extract benefits from the results of competitive financing of projects within the EU Framework Program for Scientific Research and Innovation «Horizon Europe». However, there are many obstacles. For example, the presence and compliance of tasks and powers with the proper ministry in the sphere of science. Ukraine is only gaining experience in participating in such programs. Accordingly, the tasks and powers of the Ministry of Education and Science of Ukraine in the sphere of science require rethinking, changes. To do this, it is necessary to consider the tasks and powers of the relevant ministry in the sphere of science of those EU member states that are slightly ahead of Ukraine in receiving the above funds (for example, the Czech Republic, the Republic of Finland, the Republic of Latvia, Romania). Analysis of recent researches and publications. The legal literature does not pay attention to the tasks and powers of the relevant ministries in the sphere of science in the EU member states. One of the reasons is the constant reformation of such ministries without the possibility of assessing and tracking their results over a certain period. However, it is possible to single out works where they are mentioned without any analysis: Golovashchenko O., Liubchych A., Ogienko I., Lisovol O., Vedenyapina М., Pasko D. Purpose of research is to analyze Czech, Finnish, Latvian and Romanian legislation regarding the tasks and powers of the relevant ministry in the sphere of science and, if necessary, formulate author’s proposals for improving legislation in this area. Article’s main body. The article analyzes the tasks and powers, enshrined at the legislative level, of the Ministry of Education, Youth and Sports of the Czech Republic in the sphere of science (the Act on the Establishment of Ministries and other Bodies of the Administration of the Czech Socialist Republic (number 2/1969 Sb.)), the Ministry of Education and Culture of the Republic of Finland in the sphere of science (the Act on the Government 28.02.2003 № 175/2003 and the Government Decree on the Ministry of Education and Culture 30.04.2010 № 310/2010), the Ministry of Education and Science of the Republic of Latvia in the sphere of science (the Regulations of the Ministry of Education and Science 16.09.2003, № 528) and the Romanian Ministry of Research, Innovation and Digitalization in the sphere of science (the Emergency Ordinance № 57 of 3 July 2019 on the Administrative Code, the Decision № 371 of March 29, 2021 on the organization and functioning of the Ministry of Research, Innovation and Digitalization and the National strategy for research, innovation and smart specialization 2022-2027 (adopted by Gov. Decision № 933 of 20 July 2022)). Conclusions and prospects for the development. It is concluded that all the ministries studied, except for the Ministry of Education and Science of the Republic of Latvia, have imperfect or absent tasks and powers in the sphere of science. The author proposes to consider the current tasks and powers of the Ministry of Education and Science of the Republic of Latvia in the sphere of science by Ukraine as one of the options, because they are disclosed for each component, have not changed and are focused on receiving grants. Another proposal was the adoption of the experience of Romania by Ukraine regarding the creation of the Ministry of Research, Innovation and Digitalization, but in its legal act regulating the legal status to outline the tasks and powers, including in the sphere of science.
