Legal regulation of knowledge transfer in the activities of Ukraine’s research infrastructures

Abstract

The article explores the legal and regulatory framework governing knowledge transfer processes in Ukraine, which play a crucial role in shaping an innovative economy and ensuring sustainable development during the country’s recovery from the devastating consequences of full-scale war. It outlines the key provisions of the Law of Ukraine “On Scientific and Scientific-Technical Activity,” which recognizes the results of scientific and technological work—including knowledge and technologies—as intellectual property objects subject to legal protection and applicable in practical use. The analysis also covers the Law of Ukraine “On State Regulation of Activities in the Field of Technology Transfer,” which details mechanisms for the transfer of technologies, knowledge, experience, and other intellectual outputs among actors in the innovation system. Emphasis is placed on the importance of a strategic vision, as enshrined in the Innovation Development Strategy of Ukraine until 2030 and the Concept of the State Targeted Program for the Development of Research Infrastructures until 2026. These documents set out objectives for integrating scientific developments into the real economy and enhancing collaboration between science, education, and business. Additionally, the article examines leading European and international practices for organizing effective knowledge transfer and intellectual property management that could be implemented within the Ukrainian context.
