LEGAL NATURE OF SEVERANCE PACKAGE UNDER THE LABOR LEGISLATION OF UKRAINE
Abstract
Problem setting. The termination of the labor contract on the grounds that established by labor legislation initiated by the employee, the employer and the third parties. But ultimately the dismissal conducted by the employer, who must follow the order of dismissal and payment procedures. The severance payment is relating to the payment procedures. The article defines the research of the procedure and the size of payment related with the dismissal of
employee.
Analysis of recent research and publications. The studying of the concept and severance payment procedure related with the dismissal of employee place in the works of Krivoy V. I., Kiselev I. J., Lushnikov A. M., Lushnikova M. V. and others. The authors analyzed the concept of severance payment and concluded that the legal regulation of such payment should be made in both centralized and local order.
Target of research. The purpose of the article is to study the nature of such phenomena as severance payment related with the dismissal of employee under the market conditions, evaluation of its size based on salary, accumulated period of work and skills.
Article’s main body. The article deals with the legal nature of severance payment related with the dismissal of employee. Particular attention is paid to the analysis of the severance payment in correspondence with salary, guarantee and compensation payment and with the state social care.
Conclusions and prospects for the development. The authors made proposals for the establishment of funds to accumulate finance to pay the severance payment related with the dismissal of employees based on salary, accumulated period of work and others.
