CONCEPT AND FEATURES OF LABOR RELATIONS

Abstract

Problem setting. The article studies theoretical approaches to the interpretation of such notions as «work», «legal
relations» and «employment relationship». Provided the author’s definition of «employment relationship».
Target of research. The article aims to explore the concept of labor relations and determine the features that
characterized them.
Analysis of resent researches and publications. The concept and essence of labor relations were the subject of
research of domestic and foreign scientists, such as V. S Venediktova, О. А. Sytnytskaya, O. Y. Lapka Y. F. Demskiy
O. V. Smirnovа, I. A. Snigirevа, K. N. Husova, V. V. Eremenko, V. V. Zhernakova, O. A. Zaporozhets, D. M. Karhalova,
T. N. Lezhnev, O. I. Protsevskiy, I. A Serdyuk, J. J. Tomilova, V. I. Scherbyna, L. S. Yavych and others. Despite such
a number of scientific research, given the socio-political changes in Ukrainian societyspecified problematic requires further
exploration and revision.
Article’s main body. In the context of our research, we can give the following definition of «work». This
purposeful human activity, making that person enters into a legal relationship with another individual or legal entity,
in order to get income for their physiological and social needs. So labor rights in this sense implies a relationship
governed by law.
Legal relations – are those specific relations must be regulated by the law and requires monitoring and control. It
should be noted that the legislation of Ukraine are regulated not all relationships, but only those that are important to
her. These relationships are and labor relations, which are the basis, the core of the legal regulation of labor law in
Ukraine.
Conclusions and prospects for the development. Thus, labor relations – is the specific type of legal relations that
occur between the individual and the employer about granting it a certain kind of work, they are always voluntary nature
and are regulated by the labor law.
We consider characteristic features of the employment relationship, are:
– Concluded only on a voluntary basis;
– Governed by labor law in Ukraine;
– Party relations are necessarily worker and employer;
– continuing in time;
– Arising from an employment contract;
– The parties indicated relationships are endowed with subjective rights and have certain responsibilities;
– Are lucrative in nature;
– Each participant of relations is responsible for violations of laws regulating the employment relationship.
