THE NATIONAL TRANSPORT SECURITY: LEGAL NATURE AND CHARACTERISTICS

Abstract

Target of research. The purpose of this article is to determine the legal nature and the content of the category of «transportation security» and its elements.
Analysis of recent researches confirms that the issue of transport security practically hasn’t been studied by scientists yet. Thus, a study on the development of transit potential of the state has been carried out by A. M. Novikova, K. M. Mykhailychenko, E. V. Belashov, T. P. Luchnikov, S. S. Shapoval, T. O. Voichenko, D. K. Preyhera, A. M. Hahlyuk and others. There some researches in the national economic security field, for example, scientific works of E. M. Belousov, G. O. Puhtayevych, V. K. Senchahov, O. O. Belkov, Yu. I. Vladimirov, L. I. Abalkina, V. O. Savina and others. The issue of transport security in economic terms considered in the works of I. M. Averikov and O. Sapronov. Article’s main body. Analysis of the content of the national transport system gives the reasons to consider it an integral part of the economic system of the state. The study of the legal of the nature state transportation security provides its affiliation to national economic security. It should be noted that the definition of the transport system and there is absent in the legislation. And as the «soviet», so the current Ukrainian legislation does not reveal the concept of the transport system, but it exists as an economic reality and acts as a complex economic system where solved the problem of interaction between all types of transport. Thus, it requires certain prerequisites for the effective functioning of the transport system of Ukraine. The first, it should be available the «tools», meaning vehicles. The second – is the connections that also must meet the requirements of safety and speed. The third prerequisite is the participant of transport relations. Given the abovementioned, we propose to define national transportation security as a condition of the state transport system that provides the balance of interests of the state, society and individual citizens and protect their interests in case of internal and external threats. Conclusions and prospects for the development. Today in Ukraine the issue of transport security almost doesn’t raise at legislative and fundamental science levels. However, the study of history proves the need for mainstreaming these issues. We consider the importance for further researches in the field of transport security legal support, identification of major threats and challenges, subjects, objects and elements of the structure.
