Abstract

. The article examines the problematic issues of legal forms of realization right by citizens to civil service and the grounds for the formation of employment legal relations with government employees. The emphasis is made on the fact that the application of the competition in the selection of civil servants improves the quality of public service personnel. The competitive examination is a social and legal method of assessment the applicants; business qualities. It is based on democratic principles: objectivity, publicity and competitiveness. We can analyze the competitive examination and elections as the grounds for the apparition of employment relations. Legal facts are analyzed as constituent elements of the actual composition and as conditions for competitive substitution of public positions.
