SYSTEM ATIZATION PROBLEMS OF NATIONAL ENVIRONMENTAL LEGISLATION IN THE CONTEXT OF EUROPEAN INTEGRATION

Abstract

Problem setting. The current environmental legislation requires significant improvements in consideration of strengthening
the reform processes. In this context, it requires the selection of the most effective ways of its reformation, based
on the experience of countries which are members of the European Union.
Analysis of resent researches and publications. Some aspects of legal regulation of the reformation of environmental
legislation of the countries-members of EU are considered in works of such representatives of the legal doctrine as
V. I. Andreitsev, G. V. Anisimova, Y. V. Vlasenko, A. P. Getman, O. B. Kyshko-Yerli, V. I. Lozo, N. R. Malysheva,
M. M. Mykiievych, V. V. Nosik, Y. O. Shevkunova, Y. S. Shemchushenko, O. A. Shompol, I. V. Yakoviuk etc. Among the
theoretical developments of foreign scientists, concerning the reformation of environmental legislation, there would be
noted the works of W. E. Butler, M. Koepfer, E. Rehbinder, E. Falletti, M. G. Faure etc.
Target of research. Given the existing problems in law enforcement it is necessary and relevant, from our point of
view to introduce the legal institution of the reformation of environmental legislation in the context of international legal
obligations, which realization would be based on the global experience of developed countries.
Article’s main body. In Ukraine there is a tendency of constant development of national environmental legislation
in accordance with the environmental legislation of other countries and international legal acts. Taking into consideration
the world experience is the essential and integral element of law-making, an important landmark during the introduction
of the legal institution of the reformation of environmental legislation, which analogues exist in the European legal space.
Conclusions and prospects for the development. The author considers it is appropriate to start the systematization
of the environmental law with the introduction of changes to the Law of Ukraine «On environmental protection», in
particular through the additions of the section «Strategic Environmental Assessment» and the article «Conceptuallycategorical
apparatus».
