VITAL ISSUES OF ADMINISTRATIVE AND LEGAL REGULATION OF POWERS OF THE DISTRICT EDUCATIONAL AUTHORITY HEAD

Abstract

Problem setting. The article is devoted to the analysis of the main aspects concerning administrative and legal regulation of powers of the district educational authority head, importance of taking into account multiple peculiarities of the sphere and modern changes in Ukraine, especially creating new legal framework.

Based on the analysis of current legal acts it was found out, that modern educational authority head has certain powers, which are contradictory and vague, and head’s administrative and legal status is not clearly legislated. This should be considered developing new Ukrainian legislation to avoid duplication within the reform of power decentralization.

Analysis of recent researches and publications. The following subject was investigated by such scientists as O. Avtenyuk, S. Andreychuk, M. Anufriev,         O. Bandurka, Yu. Bytyak, T. Boholib, I. Holosnichenko, V. Zhuravsky, N. Kornienko, M. Kurko, L. Myskiv, S. Obrusna, A. Podolyako, R. Shapoval and others.

Article’s main body.  The article aims to emphasize the importance of the development of clear range of specific powers of district educational authority head, which will help to determine head’s rights, duties and responsibilities expressly. It is also proposed to identify thematic clusters in certain areas of jurisdiction of the head. It is also submitted a detailed analysis of the current legislation on the subject of study.

Conclusions and prospects for the development. Further research of the items related to the powers in the educational sphere with current processes updating the legislative educational framework of Ukraine is needed and too important to have legally protected management of educational activities.
