Abstract

Problem setting. The most important tasks in disclosing the legal nature of the professional development of employees are the identification and analysis of its functions, since any phenomenon of social reality can realize its purpose only if it is to function. By what functions it performs, how is the implementation of the latter and with what efficiency, one can judge the very phenomenon, its main features, the significance in the life of society and the place among such phenomena, as well as the prospects of its existence and development. Like any other labor-law phenomenon, the professional development of workers performs its own inherent functions inherent in it, the main ones being educational, status, economic, innovative, educational and developing.

The purpose of this article is to analyze one of the leading functions of professional development of employees – innovative.

Article’s main body. In a context of globalization, a sharp competition requires drastic increase of innovation activity as the most effective way to increase the competitiveness of the country and its further development on an intensive basis. Innovations are new thoughts, behaviors or subjects that qualitatively differ from previous forms.

The strategy for the development of labor legislation in the modern world is increasingly linked to the innovative component. Innovative component is also observed in the case of specific types of vocational training. Education now plays an extremely important role, being one of the main types of investment in human capital. It is not only a connecting but also a constructive link in the system of three main components of the innovative economy – "science – education – production".

Conclusions and prospects for the development. Summarizing the above, we can state that the innovative, as the leading function of professional development of employees, is aimed at creating conditions for the formation, dissemination and implementation of ideas aimed at solving professional problems of a qualitatively new class. Its main purpose is to reveal the legal nature of the professional development of employees, since any phenomenon of social reality can realize its purpose only if it is to function.

In modern conditions, the country's innovative potential depends to a large extent on the professional qualifications of workers. It is vocational education that is a factor that can create a stable worker qualification and provide an opportunity to respond promptly to the rapid changes in production technologies.

And, importantly, the innovative type of development, which is now actively promoted by our state, requires the formation of a new educational policy and the intensification of innovative changes in all components of the education system. In this connection, there is an urgent need to update the legislative field, which would ensure the legal and organizational principles of state management of innovation activities in the educational sector and stimulate the innovative activity of its subjects.
