APPOINTMENT TO THE POSTS OF CHAIRMEN AND DEPUTY CHAIRMEN OF LOCAL STATE ADMINISTRATIONS AS A BASIS FOR THE EMERGENCE OF INDIVIDUAL LABOR RELATIONS

Problem statement. The problem of understanding the term “appointment” leads to ambiguity of its application in legal acts, because the definition of “appointment” at the legislative level is not defined. And such variety of application of this term in texts of laws blurs legal borders of this concept, brings confusion in differentiation of the bases of emergence of labor legal relations, in particular, concerning a separate category of civil servants-chairmen of local state administrations and their deputies.
Analysis of recent research and publications. Theoretical and practical problems of appointment of civil servants and competition to fill the vacancy were investigated by such scientists as M. G. Alexandrov, A. S. Pashkov, Isakov V. B., V. I. Prokopenko, V. V. Eremenko, N. M. Neumyvaychenko, L. V. Solodovnik, K. Yu. Melnik, M. P. mokritskaya, O. V. Lavrinenko, A. A. Movchan, A.V. Bykova, V. V. Buzusiy, and others.
Presentation of the basic material. The article is devoted to the study of the concept and role of appointment as a final legal fact in the system of legal acts when filling the posts of chairmen and Deputy chairmen of local state administrations. In particular, the historical aspects of the development of this legal concept, the content of the concept of appointment. Expediency of application of this method for replacement of posts of chairmen of local state administrations and their deputies, its efficiency of application in practice is proved. Theoretical bases of application of actual structures at emergence of labor legal relations are considered.
Conclusions. When appointing the chairmen of local state administrations (regional, district), the elements of the actual composition that generates labor relations are: (a) the act of representation issued by the Cabinet of Ministers of Ukraine; (b) the act of appointment issued by the President of Ukraine; (C) fixed-term employment contract in oral form.
