Abstract

Problem setting. In today’s context, equality and anti-discrimination issues are turning into one of the key areas of human rights protection. The prohibition of age discrimination as well as health, disability and sexual orientation is seen as a second generation of equal rights. As a result, the fight against age discrimination is not yet a priority in the development of international legal and national equality instruments. It is still regarded as a new area of anti-discrimination, although it has received increasing attention lately.

Analysis of recent research and publications. Various aspects of the principle of non-discrimination have been the subject of research by many authors, he is devoted to a large number of works, most of them belong to such Ukrainian authors as: MV Buromensky, VG Butkevych, MM Hnatovsky, VN Denisov, V I. Evintov, L. G. Zablotskaya, V. A. Kapustinsky, D. N. Kitsenko, V. V. Mitsik, V. E. Marmazov, P. M. Rabinovich, V. M. Sorokun, A. L. Fedorova, TI Shynkarenko, SV Shevchuk, EV Shishkin, VA Yavir and others. In foreign doctrine fragmentary developments are contained in the works of A. Kh. Abashidze, Yu.A. Antonova, VA Bachinina, M.-F. Belvedere, J. Brown, A. M. Vavilova, T.A. Vasilyeva, M. Godosh, L. M. Goya Danso, T. K. Zhitkova, V. A. Kartashkin, R. Kerr, I. I. Lukashuk, J. Murdoch, A. Perotti, T. M. Petukhova, Y. A. Reshetov, Yu. V. Sapronov, K. Tomashevsky and others.

Article’s main body. This form of discrimination is less apparent than other forms of discrimination, since the physical and mental capacity of the individual may change over time, and not all age-related differences in treatment may be regarded as prohibited discrimination, particularly in the field of employment.

Conclusions and prospects for the development. The eradication of age discrimination cannot be achieved solely by ensuring equal treatment of persons, regardless of age. This requires changing policy priorities for young people and seniors, developing minimum standards of service or individual products for different age groups, monitoring service delivery, and conducting regular consultations with community organizations that represent their interests. Serious attention should also be paid to raising the legal literacy of the population, in particular by preparing and distributing social advertising, thematic publications and programs in the media.
