THE LEGAL REGULATION OF THE DISMISSAL OF EMPLOYEE FOR COMMITTING OF AN IMMORAL MISDEMEANOR: THE HISTORICAL APPROACH
Abstract
Problem setting. This article is devoted to historical issues of legal regulation of dismissal for committing an immoral misdemeanor. It is one of the most unexplored problems in the theory of labor law science because of the relatively short existence of this institute. Analysis of recent researches and publications. In this article have been analyzed publications of B. M. Babii, A. P. Taranov, A. I. Rohozhyn in the field of historical development of Ukraine, specifically in the sphere of labor legislation. Those researches include the different historical approaches to legal regulation of employee’s dismissal through the development of Ukrainian statehood. Target of research. The aim of this article is to research the development of labor legislation in Ukraine in the prerevolutionary period, the Soviet period and its condition today and to establish the causal connection between the dismissal as a social phenomenon and fixing this phenomenon in law. Article’s main body. The main idea of the article is to show the historical development of labor legislation in Ukraine, especially in the sphere of employee’s dismissal; to describe main attainments of labor legislation in regulation of employee’s labor with using of the historical approach; to give comparative characteristic of the main labor acts of Ukraine in the different history periods. Conclusions and prospects for the development. By the result of work have been formulated conclusions on further improvement of labor legislation in the field of dismissing workers for committing of an immoral misdemeanor.
