Abstract

Problem setting. As a result of the long-term Russian-Ukrainian war in Ukraine, the number of war veterans continues to grow rapidly. Their discharge from military service is inevitably accompanied by a reintegration process, an important component of which is ensuring the veteran’s employment. Since employment can be an effective way for a war veteran to return to civilian life. Studying the existing regulatory legal acts that regulate the process of employment of war veterans, we came to the conclusion that the regulation of this issue will be effective only if the legal regulation of such social relations and, accordingly, their legislative consolidation is concentrated in a separate regulatory legal act. Within the framework of this publication, we will try to clarify the essence of the right to work of war veterans on the basis of national legislative acts in the field of labor and outline the essential features of this special category of persons. It is also necessary to pay attention to the fact that in modern Ukrainian legislation there are uncertainties regarding the understanding of the concept of “war veteran” and the list of persons who may have such status. Therefore, in order to fully understand the essence of the legal status and further determine its features that distinguish subjects of labor relations from each other, it is necessary to study the definition of the concept of “war veteran” in the current legislation of Ukraine and in the works of domestic scientists. Analyses of recent researches and publications. In scientific literature, the concept and essence of legal regulation of labor relations with war veterans are the subject of research by many Ukrainian scientists, in particular: N. Bolotina, N. Vapnyarchuk, M. Vasilyeva, V. Kokhan, R. Pogosyan, P. Rabinovych, A. Sydorenko, N. Stativka, O. Shapovalova, O. Yaroshenko and others. Article’s main body. Review of the current legislation of Ukraine on ensuring the labor rights of war veterans, conducting a general analysis of this legislation, identifying norms that require revision. To formulate proposals for improving Ukrainian legislation that regulates the mechanism for exercising the right to work by war veterans, providing them with adequate wages, acquiring professional skills, and career development. Purpose of research. The purpose of the article is to review the current legislation of Ukraine on ensuring the labour rights of war veterans, to conduct a general analysis of this legislation, and to identify the provisions which need to be improved. To formulate proposals for improving the Ukrainian legislation regulating the mechanism of exercising the right to work by war veterans, ensuring their proper salary, acquisition of professional skills and career development. Conclusions and prospects for the development. Thus, the current system of regulatory and legal acts that to one degree or another concerns the regulation and implementation of labor rights by war veterans still remains insufficiently effective. The process of improving the legislation of Ukraine in the field of labor rights of war veterans and social protection of combatants is ongoing: the norms are revised and supplemented, but it is still not unified. The absence of a special regulatory and legal act means that war veterans in Ukraine do not have special conditions and guarantees when hiring. Also, the employment of war veterans does not provide for any benefits for employers who hire this category of people. Only if a serviceman became disabled as a result of the war, are he covered by the guarantees and rights of persons with disabilities. The state of the labor market and the level of providing war veterans with jobs are very low. The longer martial law lasts on the territory of our state, the greater the risks of losing new enterprises, territories and reducing the overall level of the state’s economy. In this regard, there is a high probability that after the war, the demand for decent work among citizens will significantly exceed the market supply. And such a poorly protected category of people as “war veterans” will not be able to be competitive in the labor market at all without state support.
