THE SYSTEM OF LABOR-LEGAL BENEFITS AND COMPENSATIONS FOR DIFFICULT AND HAZARDOUS WORK CONDITIONS
Abstract
Problem setting. The main direction of state policy in the work safety field is to reduce the occupational injuries and
illnesses, reducing the factors of harmful effects on the body and reducing the number of jobs with harmful and difficult
work conditions. Achieving these goals is possible through the complex (a) resolution of work safety issues, (b) implementation
of science and technology achievements in the production, (c) mechanization of production processes and
replaces the manual labor. Employees performing theirs work in hazardous and difficult working conditions have the
special guarantees to prevent occupational injuries, diseases, neutralizing the harmful effects of the working environment
on life, health and capacity to work.
The aim of the article is to study the legal regulation of benefits and compensation for employees working in difficult
and hazardous conditions.
Article’s main body. The main task of the work safety at the enterprises is to improve working conditions and on
this basis to reduce partly or fully all kinds of benefits and compensation, but as long as the heavy physical work remaining,
while jobs with the harmful production factors remaining, the employers must follow the rules granting all statutory
benefits and compensation in order to reduce the negative impact of these factors on health.
Ukraine’s legislation with the aim to prevent the occupational diseases provides for the right of employees (working
in particularly hazardous conditions) to obtain preventive nutrition. The latter appears as a hot breakfast before work. In
some cases, allowed for consultation with medical and sanitary body of the enterprise.
At work with harmful working conditions milk or other equivalent foods issued to employees for free by the established
norms. Enterprises independently resolve the issues related to free delivery of milk or other equivalent food to
employees.
Conclusion. Therefore, ensuring of safe working conditions of employees is one of the main objectives of both the
state and the employer. It manifests in a complex economic, technical, sanitary and legal measures aimed at accelerating
technological progress, automation and mechanization of production processes, replacing manual labor by machines,
improvement working conditions. All enterprises, institutions and organizations should take care of the safety and health
of their employees. The duty of the employer is to develop comprehensive measures on labor protection to guarantee safe
and healthy working conditions in the workplace.
