LEGAL NATURE OF MORAL ENCOURAGEMENT TO THE COMPLIANCE WITH LABOR DISCIPLINE

Abstract

Problem setting. The main means of maintaining high labor activity of workers is to create favorable working conditions, proper psychological climate in the team, moral and material incentives. The initiative, creative activities are based mainly on the internal belief of the person. This initiative is stimulated with the activities of moral and material nature through public recognition, acceptance, positive assessment of worker’s success. The role of such arragements takes encouragement, which acts as a form of conscientious performance assistance of employee’s job duties, it is an expression of a positive assessment of the results of a worker in the performance of its work function. Chosen topic relevance is determined by to the fact that the system of incentives is quite extensive in the current legislation norms of the central to local and demands defined specification. The process of labor legislation reform is rather slow in our country. On the agenda of this process is the adoption of the Labor Code of Ukraine, therefor appears a necessity in special paying attention to the issue of labor discipline applying moral encouragement as a means to ensure labor discipline.
Analysis of recent researches and publications. Analysis of research and publications shows that the encouragement issues in the elements system of the employment relationship studied in the works of legal scholars, including experts on labor law: N. B. Bolotina, O. V. Smirnov, L. D. Ukhova, I. V. Lazor, Y. P. Dmytrenko, K. Y. Mashkov and others. However, considering their achievements it should be emphasized that researched issue studied fragmentally that determines closer and more comprehensive analysis of the subject of moral encouragement legal nature.
Article’s main body. The main purpose of the encouragement appliance to the employee is: implementation of internal subjective and external objective incentivea in the individual behavior. The draft of Labour Code of Ukraine lawmakers paid attention to this issue and has identified certain incentives. According to Art. 257 for success in work and conscientious performance of job duties to employees may apply the measures of moral and material incentives –a commendation issueing, a diploma awarding, a bonus payment, a valuable gift handing. Other incentives may be established by rules internal work schedule, employer’s regulations. Material are those legal incentives, which have a positive effect on the mind and therefore the worker’s behavior by giving him some material goods which satisfy his physical and / or psychological needs as a humanbeing and an individual. Moral and legal aspects of incentives distinguishe it from material awarding, bonuses, incentive payments, in which the moral aspect is not evident or evident to a lesser extent. The essence of moral encouragement is the official and public recognition of the workers’ achievements and their specific role in the overall success of the company. On the one hand, the moral encouragement stems from the labor process itself – is satisfaction with the achieved result and feeling sense of what is happening (the labor process and the positive reaction of the employee in this process is the basis for moral satisfaction) and, on the other – moral encouragement expressed in nonmaterial formal or informal recognition of employee achievements, which, in particular are: commendation issueing, awarding the diploma of the organization, the title for the best professional qualities, adding to the Board of Honour, the Gallery labor glory, honor books, corporate awards. This
type of promotion is expressed in the ceremony honored employee corporate badge breastplate and a medal, which, in turn, duplicate departmental government and the more badges. Conclusion. Thus, analyzing the above, attention should be paid to the fact that the material and moral incentive arrangements relate in inseparable unity. Every encouragement should be reasonable, and therefore it is necessary to create a special system that will be, furthermore, an additional incentive for employees. It is impossible to build a society characterized by signs of democratic and law as a social state-organized society, based only on the principle of material interest.
