CLASSIFICATION OF ORGANIZATIONAL-MANAGEMENT RELATIONS IN LABOR LAW
Abstract
Problem setting. In the process of the reform of labor legislation in Ukraine there is need of improving organizational-management relations in the field of labor law, taking place at all levels of social dialogue - local, territorial, sectoral, national. It is the quality of legal regulation of organizational and management relations, adequacy and optimum methods and forms of their implementation depends on the effectiveness of interaction of organizational and management relations, the impact of their joint work and under the stability and profitability of the operation of enterprises, institutions and organizations. Organizational and management relations, are the subject of labor law, are numerous and according to different classification criteria differ by type, by the nature of the content and regulation of certain organizational and managerial relations in labor law, indicating the relevance of research data classification relationships.
Target of research. The purpose of the article is research and grading of improvement of organizational and management relations, are the subject of labor law.
Analysis of resent researches and publications. Question classification of relations in the field of labor law is the subject of research by many scientists: N.B.Bolotinoyi, P.Y. Buriak, V.S. Venediktov, R.Z. Lifshitz, M. Lushnikovoyi, A.R. Matsjuk, P.D. Pylypenko, V.I. Prokopenko, A.I. Protsevskoho, G.I. Chanyshev and others. However, the types and classification, including organizational and managerial relations in labor law remain scarcely explored.
Article’s main body. Organizational and managerial relationships that are the subject of labor law is broad and diverse content, and require a comprehensive classification of the different characteristics to take account of certain specific types of relationships and improvement of legal regulation in general.
Conclusions and prospects for the development. As a result of research examined the following comprehensive classification of organizational and managerial relationships, are the subject of labor law:
1) on the subject composition;
2) depending on the functional nature;
3) according to the environment of origin and implementation;
4) the content of organizational and managerial relations in the field of labor law;
5) for specific connection with the employment relationship (or time of occurrence of organizational and managerial relations);
6) by priority regulation;
7) on the role of the state in the implementation of organizational and managerial relationships in labor law;
8) the type of law governing the relationship;
9) other organizational and managerial relationships, are the subject of labor law (for reasons of origin, for the period of validity, the scale of the action, for purposes of implementation, etc.).
