“WORK SAFETY (SAFE AND HEALTHY WORKING CONDITIONS) AS A COMPONENT OF “DECENT WORK” IN LABOR LAW”

Abstract

Problem setting. Rapid scientific and innovative development of the world economies, comprehensive computerization and modern globalization values in philosophical notions of the international community determine the emergence and spread of many work humanization theories in science, including the labor law science, such as the intellectualization of labor, democratization of governance at production and others. These modern theories of work humanization aimed to ensure decent living standards of employees and their families, without compromising the possibility of such living standard ensuring for employees' future generations.

Target of research. The aim of the article is to highlight the nature of the legal categories of "decent work" and "work safety (safe and healthy working conditions)" and to conduct the correlative study of these concepts.

Analysis of recent research and publications. Scientific researches of certain issues relating to the essence and content-related characteristic of the concepts of "decent work" and "work safety (safe and healthy working conditions)" have been conducted by N. B. Bolotina, V. O. Holovchenko, H. I. Kaplina, T. A. Kolyada, I. V. Lagutina, S. S. Khudyakova, N. M. Khutoryan, G. I. Chanysheva , I. I. Shamshina and others.

Article's main body. The article highlights the essential features of the concepts of "decent work" and "work safety (safe and healthy working conditions)" as categories of labor law conceptual framework. Correlation study of these multifaceted categories in the light of the decent work concept has been conducted.

Conclusions and prospects for the development. The decent work concept stimulated to rethink the meaning of such concepts as "work conditions", "work safety (safe and healthy working conditions)". The labor law terminology replenished by such categories as "decent work", "the right to decent work". The main component of decent work is a work safety (safe and healthy working conditions). After all, if the employee's working conditions are hazardous, there are no grounds to qualify such work as decent work. Defined by the author, all new researching areas of studying the concept of decent work will allow to researchers to identify new, essentially important features of the right to decent work in an objective and subjective sense.
