ESSENCES OF PRINCIPLES OF LOCAL SELF-GOVERNMENT

Abstract

Problem setting. Article is devoted to one of actual problems of the constitutional and municipal right. The local government can't exist in modern conditions to not spheres of certain standard requirements (principles) which answer national statehood, universal values, and democratic ideals. The modern principles and forms of local government – result of difficult process of search of a compromise in the person of territorial associations and the state which is directly connected with efficiency of the public power, rationality, and its system and structural organization.

On the nature principles of local self-government belong to the sphere of legal ideology; it is the certain system of base politically legal ideas of conceptual character, that touch this subsystem of public power. Principles of local self-government if carry out the role of the generalized reference-point of municipally-legal ideology.

Analysis of resent researches and publications. The following scientists were engaged in research of the specified question O.O. Bezuhlov V.V, Kravchenko and M.V Pittsyk, O.T Voloshchuk,, I.I. Bodrov, S.G. Seregin, K.E. Solyannika, P.M. Liubchenko, A. Lyalyuka, V.P. Kolesnik, J.G. Barabash, J.N. Todyky, V.D. Jaworski. and others.

Article’s main body.This work is devoted to the question of the essence of the principles of local government. Unfortunately, this issue has recently not been paid sufficient attention, especially in terms of the latest trends in globalization. Due to the high dynamics of the process of constitutional development in Ukraine, insufficient analysis of the aforementioned issues is an obstacle to the solution of many derivative problems caused by the realities of the present constitutional system of the entire municipal law.

An objective conditionality that envisages their accordance of character and to existent development of public relations status comes forward as an important sign of principles of local self-government, and also economic, to the ideological processes really existing in society. Principles have constituent character, ides called to create terms for functioning and development of all subjects of local self-government. They integrate, unite and do possible existence of other municipally-legal institutes.

Conclusions and prospects for the development. Summing up, it should be noted that our country mentioned problems actualized implementation of municipal reform, improve public administration in terms of centralization and decentralization of power, balance national interests with the interests of the regions and local communities, stimulating economic growth areas.
