Abstract

Problem setting. The purpose of the lease (lease) agreement is to meet the temporary need of the tenant in a particular property. Regardless of the term of the lease agreement (lease), the relations under this contract are terminated sooner or later. Except for the general grounds for termination of the obligation, the lease (lease) contract may be terminated on the special grounds prescribed by law for termination of this very contract. The possibility of termination of the lease (lease) on special grounds is determined by the nature and features of the lease (lease) relationship.

Analysis of recent researches and publications. The issue of contractual relationships was studied by legal scholars in different ways. Research in this area was conducted by M. Aharkov, S. Aleksieyev, M. Brahinskyi, O. Krasavchykov, O. Ioffe, V. Luts, I. Spasibo, Ye. Kozarenko, V. Steshenko, M. Pronina, S. Puhinskyi, T. Potapenkova, Yu. Basin, D. Levenson, N. Haschivska, N. Milovska and other scientists.

Target of research. The aim is a comprehensive study and analysis of particular special grounds for termination of the lease agreement(leases).

Article’s main body. The article provides a legal analysis of the special grounds for termination of the lease agreement (lease). The following special grounds for termination of the lease (lease) were investigated as the death of the natural entity of a leasee, the refusal of the leasee if the leasor does not hand over the subject of the lease to him, the refusal of the leasor if the leasee does not pay for the use of the property during three consecutive months, termination of the agreement on the leasor’s request, termination of the lease agreement on the leasee’s request.

Conclusions and prospects for the development. Summarizing the results of the study we can formulate the following conclusions. First, defining some grounfs for termination of the lease (lease) contract as special by the legislation is determined by the essence of the legal relations that arise from it. Secondly, we can distinguish the following types of special grounds for termination of the lease (lease): 1) those that do not depend on the will of the parties: the death of the natural entity of a leasee, the liquidation of the legal entity that was the tenant or lessor; 2) those that depend on the will of the parties: the refusal of the leasor if the leasee does not pay for the use of the property during three consecutive months, termination of the agreement on the leasor’s request, termination of the lease agreement on the leasee’s request.
