ON THE QUESTION OF ANALYSIS OF LEGISLATIVE BACKGROUND OF THE NATIONAL POLICE OF UKRAINE FOR 2018–2019

Abstract

Problem setting. The activity of any public authority in the country depends on many factors: a high level of management and organization of work, the level of professional training and qualification of staff of officials and officials, the introduction of innovative mechanisms and modern technological developments in the exercise of powers, as well as the presence of clear defined legal framework of activity. Since 2015, a new system of National Police bodies has started operating in Ukraine. Such changes have become not only a reshuffle, but also more cardinal transformations. In particular, the normative base of activity of police bodies has been completely updated: a special Law of Ukraine «On the National Police» has been issued, relevant amendments have been made to the Code of Ukraine on Administrative Offenses, and a number of subordinate legal acts have been adopted.

Target of research. The purpose of the study is the analysis of changes that have taken place in the regulatory acts regulating the activities of the National Police of Ukraine for 2018–2019, as well as research on the basis of this latest performance of these bodies, which resulted from such changes.

Analysis of recent researches and publications. The following scientists analyze separate aspects of the question in their researches: O. Bandurka, O. Bunchuk, O. Kaliuk, V. Kulikov, A. Halai, M. Loshytskyi, O. Kaplya, O. Pronevych and others.

Article’s main body. The main act of police activity is the Law of Ukraine «On the National Police» of 2015. To date, the Act has about 20 changes, most of which were introduced in 2018. These amendments do not substantially change the rules, but only specify them in relation to certain legislative updates in other areas of law.

Other important changes in the activities of the National Police occurred on the basis of resolutions of the Cabinet of Ministers of Ukraine. For example, the Resolution of the Cabinet of Ministers of Ukraine «On Approval of the Procedure of Conducting the Assessment of Population Confidence in the National Police» of 07.02.2018 defines the main mechanism of such assessment, principles and tasks, establishes its subjects and periodicity.

The broadest range of issues related to the internal organization of police work is enshrined in the acts of the Ministry of Internal Affairs, registered with the Ministry of Justice of Ukraine. It was on the basis of such documents for the years 2018–2019 that a number of new bodies and units were created within the National Police structure.

Conclusions and prospects for the development. At the moment, based on the conducted research, we can only speak about whether the dynamics of police activity will be constant. Not only the legal regulation of modern living conditions, but also the practical realization of the rights and duties of police officers remain unresolved. Thus, to say that the reform of the police in Ukraine has been completed or is not coming to an end is not justified. Yes, the National Police is actively pursuing all its intended goals, but in order to fulfill its tasks effectively, it must constantly update itself and develop itself, taking into account changes occurring both in the life of the country and in the world arena.
